Description of Service

The Client agrees to purchase the products and/or services as outlined in the invoice. 

 

The quote is based on the hourly rate outlined in the invoice. This estimate is based on how much time the work is expected to take, with consideration to the complexity of the project. 

• If the project takes less time than expected, the invoiced price will be reduced accordingly. 

• If significant changes are made to what was originally agreed upon, for example, if the initial quote did not include grading and we decide to add it, or for grading projects, if there is a significant change to the construction, gauge, or sizes to be offered after the initial work has already begun, this will change the quoted time needed.

• If a pattern requires lengthier rechecks that are expected to take more than 15 minutes beyond the original quoted time, I will notify you in advance of adding this work time to the invoice. 

 

Refund/Cancellation

Refunds are not normally offered, as services are billed for the time required to complete the work. However, if the client is in any way unsatisfied at any time, contact Nicky Jensen and best efforts will be made to resolve the issue in a timely manner and to the Client’s satisfaction. 

 

Force Majeure

Nicky Jensen shall be excused from any delay or failure in performance required hereunder if caused by reason of any occurrence or contingency beyond its reasonable control, including, but not limited to, acts of God, acts of war, fire, insurrection, strikes, lock-outs or other serious labor disputes, riots, earthquakes, floods, explosions or other acts of nature.

 

Limitation of Liability

The Client acknowledges and agrees that Nicky Jensen will not be liable for any losses or damages, whether indirect, incidental, special or consequential, in profits, goods or services, irrespective of whether or not the Client has been advised or otherwise might have anticipated the possibility of such loss or damage.

 

No Guarantee

The client acknowledges and agrees that Nicky Jensen cannot guarantee the results or effectiveness of any of the services rendered or to be rendered. Rather, services shall be executed in a professional manner and in accordance with good industry practice. Best efforts will be used but no results are promised.
